Welcome to Manifestation.Monster. These Terms of Service ("Terms") govern your access to and use of the Manifestation.Monster website and the 7-Day Sprint services ("Service") provided by Denis Aleksandrovich Bystruev ("we," "us," or "our"). By purchasing or using the Service, you agree to be bound by these Terms.

1. Description of Service

The Service is a 7-day concierge digital marketing package that includes the creation of a custom artificial intelligence (AI) video avatar, an instant voice clone, AI-generated video scripts, and automated daily publishing to selected social media networks.

2. Artificial Intelligence and Avatar Consent

By uploading your video and voice samples, you provide explicit, revocable consent for us and our third-party AI partners (including HeyGen) to process your biometric data (face and voice) for the sole purpose of creating your digital avatar.

• You warrant that you are the individual depicted in the video and audio samples.
• You may not submit media of any other person, celebrity, or copyrighted character.
• We reserve the right to immediately terminate your service without refund if we suspect the submitted media violates the likeness rights of a third party or is intended for malicious deepfake generation.

3. Social Media Account Access and Risks

To fulfill the automated posting portion of the Service, we require access to your designated social media accounts.

• You agree to grant us the necessary permissions, tokens, or credentials required to publish on your behalf for the duration of the 7-day sprint.
• Assumption of Risk: Social media platforms frequently update their terms regarding AI-generated content and automated publishing. While we use standard automation tools, you acknowledge that automated posting carries an inherent risk of account flagging, shadow-banning, or suspension by the platform. We are not liable for any penalties, loss of access, or damages incurred to your social media accounts.

4. Payments and Refund Policy

The 7-Day Sprint is a one-time purchase of $149. Due to the immediate hard costs incurred through third-party API rendering engines upon onboarding, all sales are final. We do not offer refunds once your video and voice samples have been submitted and the avatar generation process has begun.

5. No Guarantee of Results

We provide the technical generation and publishing of content. We do not guarantee any specific social media metrics, follower growth, engagement rates, or financial returns resulting from the Service.

6. Intellectual Property

You retain full ownership of the original video and audio files you submit. Upon completion of the Service, you own the final rendered videos. You grant us a temporary license to utilize your likeness and accounts strictly to fulfill the 7-day Service.

7. Limitation of Liability

To the maximum extent permitted by law, Manifestation.Monster and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions.
